All you need to register a Trademark in Thailand, if you reside here, is a scanned copy of passport, both the ID and visa pages, or a scanned copy of your Thai ID, and a signed and notarized Power of Attorney (supplied by Plizz). The POA does not need to be notarized if you are a Thai citizen.
Foreigners can own 100% of a trademark in Thailand, without any need for Thai partners. This can offer you some protection against majority owners (see company registration requirements), as long as it is clearly established that you alone have the sole right to register and own the mark.
Timeline for Registering a Trademark in Thailand – Meeting the Requirements
It is a lengthy process registering your trademark in Thailand, however limited protection starts as soon as your application is filed, as Thailand is a first to file country. What this means is the first person to file for a trademark becomes the priority right holder, even if your trademark has not finished the registration process any similar or identical trademark filed after you file your application, for the same products, will be rejected, as long as yours successfully achieves registration. Even if the Registrars don’t cite your mark against the new similar one, you have rights, as the first to file, to file an opposition against the new mark blocking its registration.
It takes roughly 12-14 months before the first Office Action (an official notice from the Trademark Office) is sent to our lawyers. If everything goes right the first action should be a notice that your new brand is about to be published for opposition (a 60-day period in which anyone who thinks they own the mark already can file to stop your registration). If all goes smoothly, it usually takes about 18-20 months to register a mark.
