Trademark registration in Thailand

Thailand protects the first to file, not the first to use. Whether you are launching a brand, have spotted a copycat, are preparing to franchise, or a buyer wants proof of ownership, trademark registration in Thailand should come early. Narai Partners, the legal arm of Plizz Group and an IR Global member, handles the whole process with the Department of Intellectual Property (DIP).

How It Works

Our Process

A clear, structured approach from start to finish.

  1. Step 1:Brand assessment

We learn your brand, the goods and services it covers, and your filing priorities before any form is filled in.

  2. Step 2:Trademark search

A full search of the DIP register for identical marks and for marks that look or sound similar in your Nice classes.

  3. Step 3:Application filing

We prepare the Thai-language application and file it with the DIP. Your filing date sets your priority.

  4. Step 4:Examination and response

We follow the DIP examination. If the examiner issues an office action, we respond within the deadline.

  5. Step 5:Publication and opposition

The mark is published in the Trademark Gazette, and third parties have 60 days to oppose. We watch for oppositions and defend your application.

  6. Step 6:Certificate and ongoing protection

Once registered, you receive the certificate. We track your renewal date and watch for infringing marks.

Transparent Pricing

  • All Plizz fees exclude 7% VAT.
  • DIP government fees are published and pass-through (~1,000 per class for filing + ~1,000 per class on grant).
  • Term: 10 years, renewable indefinitely.
  • Trademark Search before filing is strongly recommended: proceeding without a search risks rejection (engagement fee + DIP fee both become sunk cost).
  • Foreigners can own 100% of a Thai trademark: no need for Thai partners.

What happens when you skip the pre-filing search

The DIP examiner finds a conflict with an earlier mark, and an office action is issued. The response deadline starts at once. If the response fails, the DIP filing fee (about THB 1,000 per class) and any professional fee are lost. Your attempt stays on the public record, which makes a second filing harder, and a competitor may file the same mark in the meantime.

A clearance search and a properly drafted filing almost always cost less than a failed DIY attempt followed by a rescue.

Commercial value

What a registered trademark lets you do

Registration is not only a legal formality. It gives your brand commercial uses that an unregistered mark does not have.

  • Infringement enforcement: the registration is evidence of ownership, so you can act directly against infringers instead of proving a passing-off claim
  • Brand licensing income: licensees expect a registered mark, and royalty agreements are simpler to draft and enforce when you hold the certificate
  • Franchise expansion: franchisees in Thailand, and in ASEAN through the Madrid Protocol, usually require a registered mark in the franchise agreement
  • M&A due diligence: buyers and private equity investors discount unregistered brands; registered marks pass due diligence and protect the price
  • Regional filing through the Madrid Protocol: Thailand joined the Madrid Protocol in 2017, so your Thai application or registration can be the base for filings across ASEAN and beyond through the World Intellectual Property Organization (WIPO)
  • Balance sheet value: registration costs can be recorded as an intangible asset under Thai Financial Reporting Standards (TFRS); Narai Partners works with the Plizz accounting team so they are treated correctly

Who this is for

Who needs trademark registration in Thailand?

In Thailand, the first to file wins, and a registration abroad gives you no rights here. These are the businesses that should not wait.

  • Foreign brands entering Thailand: a registration at home gives you no rights here. Thailand is a separate first-to-file register, and a local squatter who files first can block your own brand
  • Thai SME founders with 1–3 years of brand traction and no registration: the highest-risk profile, because the brand you have built has no legal protection until the mark is filed and registered
  • Franchisors preparing to license: franchisees in Thailand and ASEAN usually require a registered mark in the franchise agreement, and a pending application is often not enough
  • Buyers and sellers in M&A: investors check trademark registration as a standard due diligence item, and unregistered marks lead to price discounts or delays while protection is filed mid-deal
  • Growing companies with several sub-brands: each brand needs its own registration in each relevant Nice class, and planning the portfolio now avoids expensive gaps later
  • Brand owners facing infringement: a registered mark lets you enforce your rights directly; without one, you are left with slower and costlier passing-off claims
  • Importers and distributors who want to register private-label or distributor brands and protect them from parallel imports

About our team

IR Global member: 165+ jurisdictions

Narai Partners is a member of IR Global. Cross-border filings, oppositions, and enforcement go through established member firms in 165+ jurisdictions, not cold introductions to unknown foreign agents when time is short.

Thai-script sound check: the step others miss

Under Section 13 of the Trademark Act, the DIP compares how marks sound, across Thai and Latin scripts. A mark that looks different in English can sound the same once written in Thai. Our clearance search catches these conflicts before the examiner does, saving your fees and a wasted examination round.

Connected to corporate, M&A, and accounting

Narai Partners works alongside Plizz on company registration, BOI promotion, and bookkeeping. Your trademarks are recorded correctly on the balance sheet and reflected in BOI reporting and the annual audit: one team accountable, not three separate firms.

Filing, office actions, and oppositions: partner-led

A partner leads every office action response and opposition defense, based on published DIP guidelines and Supreme Court decisions on likelihood of confusion. When the opposing party is abroad, Narai Partners works through the IR Global network, not ad hoc referrals.
