Thai-script phonetic analysis: the step DIY and offshore searches miss

Under Section 13 of the Trademark Act, the DIP checks whether marks sound alike, including between the Roman-script and Thai-script versions of a mark. A mark that looks entirely different in English may sound identical when written in Thai.

The DIP online search portal cannot do this for you; it takes Thai-language trademark expertise. Narai Partners includes Thai-script phonetic analysis as a standard part of every search (not an add-on) because it is the risk most often missed in self-filed or offshore-managed applications.

When a phonetic conflict is missed: what it costs

A prior mark sounds the same as yours in Thai script. An English-only DIY search misses it, and the application goes ahead. Later, the DIP examiner finds the conflict and issues an objection. You have 60 days to respond, and phonetic conflicts are among the hardest to overcome at that stage.

The filing fee, the agent's fee, and months of brand spending are all at risk. You then choose between an expensive fight with the examiner and a costly rebrand. A professional search at the start, including Thai-script phonetic analysis, almost always costs less than a failed application.

Thailand is a first-to-file country, and Google does not index the DIP register. For these businesses, skipping the search is a real risk.
